David Schultz Article on Trade Secret Audits Featured in Minneapolis/St Paul Business Journal. An article by David Schultz, member of Maslon’s Litigation Group, is featured in the November 6, 2009 edition of the Minneapolis/St. Paul Business Journal. The article is titled “Are Your Trade Secrets Really Safe? An Audit Might Find Out,” and highlights the importance of a trade secret audit in sharpening the protections a company uses to safeguard its trade secrets.

Schultz writes, “Though trade secret audits cost money, they are worth the expense. The audit discipline assists the company in defining its trade secrets and in implementing appropriate procedures to prevent the theft or unintended disclosure of trade secrets. It also provides the company with the tools necessary to demonstrate in litigation that the trade secret has been adequately protected.” Schultz goes on to state that the audit program itself has legal and evidentiary value on the company’s behalf in showing that the company has taken reasonable measures to protect its own trade secrets.

David Schultz is a partner in Maslon’s Litigation Group focusing on trial and appellate work in intellectual property and commercial litigation, mass tort and product liability, and civil and criminal fraud. He has also developed a practice in conducting public and private investigations.

David Fights for Justice for the Family of a Slain Priest- David was approached about representing the family of Father John Kaiser, a Roman Catholic priest, who was found dead in Kenya of gunshots.  Father Kaiser spoke truth to the power of the administration of the then-Kenyan President.  Father Kaiser was in the process of exposing rape charges against a high-ranking government official when he was found dead by the side of the road.  Against long odds, David was able to force the Kenyan government to reopen the case and have Father Kaiser’s death classified as a homicide.  David was driven by his desire to see justice for Father Kaiser. David’s Pro Bono Representation of a Death Row Inmate- David is currently representing a death row inmate for the appeal of his conviction.  The client’s conviction in Texas is being challenged on several fronts, including the representation received in advance and during the trial.  David’s commitment to justice brought him to the border of Texas and Mexico to represent a poor client with only a remedial education because David believes that everyone, regardless of income, education, race, gender, age, or sexual orientation deserves justice.
